Store Terms and Conditions

I. DEFINITIONS

1. Business Days – weekdays from Monday to Friday, excluding public holidays.
2. Cart – a list of products selected by the Client from the Store's offer.
3. Client – both Consumer Clients and Business Clients.
   - Consumer Client – an individual making a purchase in the Store unrelated directly to their business or professional activity.
   - Business Client – an individual, legal entity, or organizational unit making a purchase related directly to their business or professional activity.
4. Terms and Conditions – this document defining the rules and conditions for using the Store and purchasing products.
5. Store – the online store operating under the address divineswines.com.
6. Order – the Client's declaration of intent aimed directly at concluding a distance sales contract via the Store, specifying the type and quantity of products.

II. GENERAL PROVISIONS

1. The Store is operated by 94EVER Sp. z o.o., headquartered at Świerkowa 2, 05-462 Wiązowna, Poland, KRS: 0001118822, NIP: 5322113764, REGON: 529249922.
2. Contact with the Store is possible via email at contact@divineswines.com.
3. The Terms and Conditions define the rules for using the Store, placing orders, order processing, payments, as well as returns, exchanges, and complaints.
4. Browsing the Store's assortment does not require registration. Orders can be placed as a guest or as a registered user.

III. ORDER CONDITIONS AND PROCESSING TIME

1. Products offered in the Store are available in limited quantities and can only be ordered during the sales period, which is active for 24 hours or until stocks are exhausted.
2. After the production process, which lasts a maximum of 5 weeks, the product is handed over for shipping.
3. The Store informs Clients about the timelines and availability of subsequent sales editions via the website and communication channels (e.g., newsletter, social media).

IV. PRODUCT PRICES AND SHIPPING COSTS

1. All prices displayed on the Store's website are gross prices (inclusive of VAT) and are expressed in Polish zloty (PLN).
2. Shipping costs are added to the order and depend on the chosen delivery method.
3. Free shipping within Poland is available for orders over 99 PLN.

V. DELIVERY

1. The Store uses the Apaczka.pl system for courier deliveries.
2. After the package is handed over to the courier, the Client receives an email with the tracking number.
3. The Store is not responsible for delays in delivery caused by the courier company.

VI. PAYMENTS

1. The Store offers payment via the Przelewy24 system.
2. The Client is required to make payment within 3 business days from the date of placing the order. Failure to pay within this timeframe will result in order cancellation.

VII. RIGHT TO WITHDRAW FROM THE CONTRACT

1. The Consumer Client has the right to withdraw from the contract within 14 days from the date of receiving the order without providing a reason.
2. To exercise the right of withdrawal, the Client must send an email to contact@divineswines.com with a relevant statement.
3. The returned product should be sent to the address indicated by the Store, at the Client's expense, no later than 14 days from the date of submitting the withdrawal statement.

VIII. RETURNS AND COMPLAINTS

1. The Client has the right to return the product within 14 days of receiving it, under the terms specified in the Consumer Rights Act.
2. Complaints regarding product defects can be submitted within 3 years from the date of purchase. Complaints should be sent via email to contact@divineswines.com, including details of the defect and photos documenting the issue.
3. The Store will review the complaint within 14 days of receipt. If the complaint is deemed justified, the Store will repair the product, replace it with a new one, or refund the purchase price.

IX. EXCHANGES

1. The Store does not offer product exchanges. The Client may return the purchased product and place a new order for a different size or model.

X. PRIVACY POLICY

1. The administrator of personal data processed in connection with the use of the Store is 94EVER Sp. z o.o.
2. Personal data is processed solely for the purpose of fulfilling orders, managing user accounts, and conducting marketing activities, in accordance with the Privacy Policy available on the Store's website.
